Acceptable Use Policy

This Acceptable Use Policy (“AUP”) sets out the rules and standards for using Prolisto and its features. It applies to all users and supplements our Terms & Conditions.

By using Prolisto you agree to comply with this AUP. Violation may result in suspension or permanent termination of your account without refund.

You may use Prolisto only for lawful purposes and in accordance with these rules. Permitted uses include:

• Managing pricing and repricing strategies for your own eBay or Shopify seller accounts
• Creating and optimising product listings using the AI-assisted tools provided
• Analysing competitor pricing to make informed pricing decisions for your own inventory
• Using credits and subscriptions for the features they are intended for, as described at the point of purchase

You must not use Prolisto to:

3.1 Illegal or Harmful Activity

• Violate any applicable law, regulation, or third-party rights
• Engage in fraud, money laundering, or any other criminal activity
• Harvest or collect data from the Service or from third-party marketplaces in violation of their terms of service
• Transmit malware, viruses, or any harmful or disruptive code

3.2 Abuse of the Platform

• Attempt to gain unauthorised access to any part of the Service, its servers, or connected systems
• Circumvent, disable, or interfere with security features, access controls, or usage limits
• Use automated scripts, bots, or scrapers to access the Service beyond what is permitted by the API
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Create multiple accounts to circumvent credit limits, trial restrictions, or account bans
• Resell, sublicence, or otherwise commercialise access to the Service without our written permission

3.3 Abuse of AI Features

• Submit content to AI analysis features that contains personal data of third parties, illegal material, or content that violates third-party intellectual property rights
• Attempt to manipulate or “jailbreak” AI features to generate prohibited content
• Use AI-generated listings to create misleading, deceptive, or fraudulent product descriptions

3.4 Marketplace Compliance

• Use the Service in any way that violates eBay’s, Shopify’s, or any other marketplace’s policies, rules, or terms of service
• Engage in price manipulation, shill bidding, or any other activity that distorts fair marketplace competition in a manner prohibited by applicable laws or marketplace policies
• List prohibited, counterfeit, or restricted items using the Service

Prolisto operates on shared infrastructure. To ensure a quality experience for all users, we apply fair use limits to API calls, AI analysis requests, and automated repricing runs. These limits are defined within your subscription plan or credit package.

Excessive use that adversely affects the performance of the Service for other users - even within stated limits - may be throttled or result in a request to upgrade to an appropriate plan.

When you connect a third-party account (e.g. eBay, Shopify) to Prolisto, you remain solely responsible for:

• All activity carried out via that connected account through our Service
• Ensuring your use of Prolisto complies with the relevant marketplace’s terms
• Any consequences (including account restrictions or bans on the marketplace) resulting from actions taken by Prolisto on your behalf

If you become aware of any use of Prolisto that violates this AUP, please report it to us at prolisto.com. We take all reports seriously and will investigate promptly.

We reserve the right to take any of the following actions in response to violations of this AUP:

• Issue a warning
• Temporarily suspend your account
• Permanently terminate your account without refund
• Remove any content or data associated with the violation
• Report activity to law enforcement or regulatory authorities where required by law

We may update this AUP from time to time. We will notify you of material changes via the Service or by email. Continued use of the Service after such changes constitutes acceptance of the updated AUP.
